Chemical solvent causes injuries in slip and fall accident

A man who was delivering supplies to a local warehouse slipped and fell on his way across the premises, most likely as a result of the harsh chemicals being used at that time to strip the flooring. He is now suing the employees who directed him over the hazardous area without a warning about the slippery situation.

The man sustained injuries including pain in his knees and back and groin area after the fall. He also experienced a burning sensation on his skin, which he discovered later was due to the chemicals that the warehouse workers were using to strip the flooring.

Should we change the way nursing home care is provided?

Nursing home safety and health care reform often go hand-in-hand. We recently discussed issues of dangerous prescribing practices in nursing homes around the country, with many patients being given strong anti-psychotic medications as a way to control behavior. This practice has caused injuries and fatalities for nursing home patients and has shined a spotlight on how we administer care and avoid injuries.

Advocates for nursing home patients and health care reform proponents say that an emphasis on strict regulations and avoidance-based practices have led to conditions in nursing homes that are impersonal and oppressive for patients.

Electronic prescriptions show lower rate of error, injury

A lot of jokes are made about doctor's messy handwriting, but the reality is much more serious. Illegible or confusing handwriting on a prescription can lead to serious errors at the pharmacy, causing injury or fatalities for patients. As other parts of the healthcare system transitions to digital technologies to save money and prevent errors, some experts have begun to question why prescriptions are still largely handwritten.

Only about 36 percent of prescriptions were created and delivered to pharmacies electronically last year, despite a significantly lower error rate compared with handwritten prescriptions.

2011 expected to have lowest car accident fatality rate on record

Almost every state in the country, including Delaware, is expected to have a record low number of fatalities from car accidents for 2011. Authorities have not collected all of the data yet, but the majority of the results indicate that last year had the lowest number of traffic fatalities on record nationwide.

The decrease from 2010 was about 2 percent, which seems small but is significant over thousands of car accidents that happen each year. Accident rates have been falling in general over the past several years, largely due to safer cars and well maintained roadways. The total number of traffic fatalities nationwide this year was 32,310 according to current estimates.

Couple sues Walmart for parking lot injuries

A woman and her husband are seeking compensation from Walmart following an accident. The woman says that she was seriously injured when she fell into a hole in the parking lot at Walmart while she was loading her purchases into her car. She says she was permanently injured on the lower half of her body and suffers from significant pain and now has a disability.

The lawsuit asks for compensation for medical costs, pain and suffering, impaired earning capacity and other losses. The woman's husband is asking for compensation for loss of support and services. The parties have agreed to participate in mediation to attempt to resolve the dispute before going to trial.

Renewed concerns over prescribing practices in nursing homes

Different types of nursing home malpractice have been making the news lately. As our population ages, more and more Americans require advanced care that is only available in these types of facilities. Controversy has recently erupted over what appears to be a common practice of prescribing powerful antipsychotic medications to patients for uses outside of those approved by the FDA.

The concern over these drugs centers around the high risk of severe side effects for patients with complex medical histories who are on a wide variety of other medications. Side effects can be very serious and the drugs are sometimes fatal for dementia patients. The revelation that the drugs are being improperly prescribed will potentially lead to many nursing home malpractice lawsuits.

Delaware man arrested after extended chase, two car crash

A Delaware man caused quite the commotion earlier this week when a local police officer tried to pull him over for a traffic violation. He has been arrested and charged with various levels of criminal misconduct as a result of the chase that followed the officer's initial attempt to stop the man.

According to police accounts, the man initially appeared to comply with the signal to pull over, but then sped off in another direction suddenly. He pulled out onto the highway again and narrowly missed another police vehicle coming from the other direction. Next, he sped onto a different road and hit the front of another vehicle, causing significant damage before he raced off again.

Doctor sued for using clinical trial treatment without consent

When a patient went to see an experienced plastic surgeon for liposuction, she assumed she was getting a standard procedure. But when she experienced irregular scarring and severe pain, she looked into the details of her procedure.

According to the medical malpractice lawsuit that the woman filed, her doctor didn't use the commonplace liposuction technology to conduct her procedure. Instead, he used a product not yet approved by the FDA. In order to use unapproved devices, doctors typically must enroll the patient in a clinical trial and often provide compensation in exchange. In this case, the woman was unaware that she was participating in a clinical trial and did not get paid.

Researchers find new approach to cerebral palsy treatment

There are many types of birth injuries and risks associated with childbirth that doctors are now able to prevent. Research continues into this area of medicine as healthcare providers seek to eliminate injuries that can occur without any signs. These are difficult problems to solve, but researchers at the National Institute of Child Health and Human Development are pursuing solutions.

One particularly difficult birth injury is cerebral palsy. This condition can be developed by a child at various phases in the womb, just after birth, or when the child is still very young. It is often hard to detect until the child is older, since it primarily affects balance and posture.

Delaware politician charged with DUI, fleeing car accident scene

A state representative currently serving in the Delaware House was arrested this past weekend for a DUI charge. It was Rep. Bennett's second DUI charge within the past 18 months, and as such carries stiffer penalties. Police arrested him after his SUV side-swiped a parked police cruiser and he drove away. The politician has also been charged with leaving the scene of a car accident.

Driving while intoxicated is both illegal and considered negligent behavior. As such, the politician will likely be held responsible for the damage he caused to the police car and any other property damage that may have occurred during this incident.
